Sally Hodges reviewed the report of McKenna Associates dated August 9, 2006, when the application was originally to come before the Commission for final site plan approval. She also indicated the applicant had met with the Township administration and a representative of the neighboring property owners with regard to installation of the screening between the project and homes to the east and south.

The report from Dietrich Bailey Associates was reviewed by Stephanie Harbour and the Fire Department report was received.

Donald Treder and Donald Treder II addressed the Commission; answered questions; presented building materials, floor plans, and building elevations, and presented the revised landscape plan.

Chairman Cebulski honored the request of residents from the area who wished to speak, though a public hearing was not being held.

Pete Kirsh, an adjacent property owner, presented three issues of concern:

1. Request for a temporary fence for protection during road construction,
    based on Article 26.101(c).
2. Request to follow Article 26.11, Item 3, which says the entire buffer
    will be installed prior to issuance of a Certificate of Occupancy.
3. Once all changes are made, they want to make sure all the storm
    water is handled.

Sally Hodges responded that the evergreen trees should be spaced closer together to create more area to handle the storm water; that in the case of a development with more than one building, the Township Building Official requires all common area landscaping that will not be affected by building construction to be installed prior to issuing a C of O; and that a temporary fence had been discussed with the applicant but no agreement reached.

Linda Alvarado, a resident of the area for 31 years, complimented and thanked the Commission for their actions on behalf of the community that resulted in national recognition as a place where it is very desirable to live.

Dan Callahan, whose property abuts most of the development, expressed concerns as to what a 3-6 year completion schedule would do to the value of his property, and asked what would assure that the required site improvements would be installed. The Commission responded that the Building Department requires a bond to ensure completion.

Moved by Commissioner Davis, supported by Commissioner Barberena, to grant final site plan approval to Application 1904/1105, DJT Development, Inc., for North Pointe Condominiums, subject to the conditions listed in the McKenna report, the Fire Chief’s report, and the report of Dietrich Bailey Associates; and that the plan is approved with phased landscaping consistent with the way the builder described it tonight and that phasing must be delineated on the landscape plan.

Jim Capo of DeMattia Group presented site plans, building elevations and materials.

Moved by Commissioner Pratt, supported by Commissioner Davis, to grant final site plan approval for Application 1923/0306, Federal Mogul Corporation, subject to items in the McKenna report being addressed—specifically, that the applicant work to address the small sidewalk issue on the south side of the building, that the lighting photometric plan is approved; that the building elevations are approved as presented; and the landscaping plan, according to the site visitation by the Commissioners, is approved as presented. Also, that the items in the Dietrich Bailey report and Fire Department report be addressed.

Seth Shpargel of McKenna Associates gave a PowerPoint presentation in answer to questions presented to the Commission by the Board of Trustees.

Moved by Commissioner Arnold, supported by Commissioner Sturdy, to receive and accept the report of McKenna Associates to answer the Board’s questions, with an addition regarding the decrease in lot sizes in Huntington Park because of its large exposure on the freeway, and that the standard size lots within the R-1-H District would be smaller than the adjacent lots at both Huntington Park to the north and Country Acres Phase 6 to the south, and to reaffirm to the Board of Trustees the Commission’s recommendation in favor of the rezoning requested in Application 1928/0506, Anica and Cane Klokanovski.

Commissioner Pratt commended and thanked McKenna Associates for preparation of the document to answer the Board’s questions.
