ITEM NO. 1 - APPROVAL OF MINUTES
Mr. Sprogell moved to approve the minutes of the Regular Meeting
of March 1, 2001 as submitted. Supported by Ron Griffith. Ayes all.
Tabled item no. 1251 has been added to the agenda.

The applicant’s proposed landsplit with the proposed Ann Arbor
Rd & Beck Rd right-of-ways, the size of each lot to be 0.45 – 0.46 acres vs. the
required 0.50 acres.
The applicant is requesting two variances:
The applicant is requesting one variance for parcel 1 of
0.04 acres or 2,006 square feet.
The applicant is requesting one variance for parcel 2 of
0.05 acres or 2,126 square feet.
Ms. Sue Dodson, representing Mr. & Mrs. Moschouris said that the
Planning Commission recommended this issue be brought before the Zoning Board.
She stated that the existing non-conforming house will be demolished and the
replacement house will be in compliance. Mr. Sprogell asked for clarification of
the process by which the Certificate of Occupancy for the new house will be
issued only after the demolition permit for the existing house is pulled and all
related utility shut offs are completed. Mr. McIlhargey confirmed that this is
the normal procedure.
Mr. Sprogell moved to approve Application 1251 for the variances
requested. Seconded by Mr. Griffith. Ayes all.

One Family Residential Districts
Schedule of regulations Article 16 – R-1 Zoning District.
Rear yard setback – 50 feet minimum.
Schedule of Regulations 16.1,z, minimum rear yard setback – 50
ft.
(z) The rear yard in an R-1-E, R-1-H, R-1-S and R-1, Single
Family Resident District may be reduced after approval of the Zoning Board of
Appeals finding that the following specific requirements have been made.
1. The single-family structure may not extend more than 10
feet into the required 50-foot rear yard.
2. The rear yard of the residence must back to the rear yard
of the adjoining residence and not a side yard.
3. The width of the single family structure extending into the
required 50-foot rear yard shall not exceed forty percent of the width of the
portion of the single family structure, which must comply with the 50-foot
setback.
4. The proposed penetration into the rear yard setback is the
only practical location for the proposed addition.
5. The completed structure will be consistent and compatible
with the other houses in the immediate area in overall size, construction,
quality, and finish and aesthetic appearance.
6. The proposed extension into the rear yard shall not have a
substantial negative impact on the open expected vistas for adjoining
properties.
7. The rear yard setback otherwise required is not less than
50-foot, due to a consent judgment or other exceptions.
8. The proposed structure shall comply with all other
requirements of the ordinance.
The applicant is requesting one variance:
The existing primary residence has an approximate fifty-seven
(57) feet, eight (8) inch rear yard setback, at the location of the proposed
addition. With the proposed twelve (12) feet x twenty one (21) feet, two (2)
inch addition, the proposed rear yard setback would be forty five (45) feet,
eight (8) inches, requesting a variance of four (4) feet for rear yard
setback.
Mr. Steve Souders addressed the Board and answered questions
regarding his request.
Mr. Levengood moved to approve Application no. 1254 for the
variance requested. Seconded by Mr. Sprogell. Ayes all.

Definitions
Item of information: any word, abbreviation or symbol used
as part a sign.
General Standards:
The following general standards shall apply to signs in the
ARC, Ann Arbor Road Corridor District:
Items of information:
In shopping centers, business centers, and other
multi-tenant buildings each tenant or business with a separate direct
outside entrance may be permitted a maximum of five (5) items of
information for its individual wall sign in addition to the total for
the premises, as specified in Section 34.10.3, paragraph b.2), herein.
The applicant is requesting one variance:
The existing wall signage for this tenant space is currently at
the maximum of five (5) items of information:
Item 1 - "CVS" over the front door
Item 2 - "CVS/Pharmacy"
Items 3, 4, 5 - "1 Hour Photo"
With the proposed "Open 24 Hours", this would add three (3)
three items of information, for a total or eight (8) items of information. The
applicant is requesting a variance of three (3) items of information for
this tenant space.
Mr. Dan Heileman, of Heileman signs discussed the reasons for
the signage requested and that they ultimately found another solution, a window
sign.
Mr. Sprogell moved to deny Application no. 1257 for the variance
requested. Seconded by Mr. Griffith. Ayes all.
MOTION TO ADJOURN
It was moved by Mr. Sprogell and seconded by Mr. Zdanek to
adjourn the meeting at 5:20 p.m. Ayes all.
