RE: Zoning Ordinance No. 83, Article XVI R-1-E, R-1-H, R-1-S and R-1 One Family Residential Districts. Schedule of Regulations 16.1, z, minimum rear yard setback - 50 feet.

(z) The rear yard in an R-1-E, R-1-H, R-1-S and R-1, Single Family Resident District may be reduced after approval of the Zoning Board of Appeals finding that the following specific requirements have been made.

1. The single-family structure may not extend more than 10 feet into the
     required 50-foot rear yard.
2. The rear yard of the residence must back to the rear yard of the
    adjoining residence and not a side yard.
3. The width of the single family structure extending into the required
    50-foot rear yard shall not exceed forty percent of the width of the
    portion of the single family structure, which must comply with the
    50-foot setback.
4. The proposed penetration into the rear yard setback is the only
    practical location for the proposed addition.
5. The completed structure will be consistent and compatible with the
    other houses in the immediate area in overall size, construction,
    quality, and finish and aesthetic appearance. 
6. The proposed extension into the rear yard shall not have a substantial
    negative impact on expected vistas for adjoining properties.
7. The rear yard setback otherwise required is not less than 50-foot, due
     to a consent judgment or other exceptions.
8. The proposed structure shall comply with all other requirements of
     the ordinance.

The applicant is requesting one variance:

The existing primary residence has an approximate fifty-four (54) feet, six (6) inch rear yard setback, at the location of the proposed addition. With the proposed fourteen (14) feet, zero (0) inch deep x twenty (20) feet, six (6) inch long addition, the proposed rear yard setback would be forty (40) feet, six (6) inches, requesting a variance of nine (9) feet, six (6) inches.

Moved by Mr. Griffith, supported by Mr. Bridgman, to approve Application 1300, the request of Donald Crowther, 45115 Pinetree Drive, for a forty (40) foot, six (6) inch rear-yard setback, a variance of nine (9) feet., six (6) inches, which falls within permitted guidelines.

(t) When an IND district is adjacent to a residential district and not separated therefrom by a street, a side yard and/or a rear yard of not less than seventy-five (75) feet shall be provided.

The applicant is requesting one variance:

The proposed addition shall have an average setback of fourteen (14) feet, six (6) inches, requesting a variance of thirty five (35) feet, six (6) inches.

Mr. Ed Meyer of L.P. Meyer & Assoc., Ltd., and Mr. Glen Sims, Vice President of Rock Tool, addressed the Board and answered questions.

Moved by Mr. Griffith, supported by Mr. Zdanek, to approve Application 1301, for Rock Tool and Machine, 45145 Five Mile Road, to grant the setback into the front yard as requested for the proposed addition.

RE: Zoning ordinance No. 83.87, Article 34 ARC - Ann Arbor Road Corridor District
Sec. 34.10 Signs

The Charter Township of Plymouth is requesting a motion to reconsider the variance granted to modify the existing non-conforming pole sign located in the ARC zoned area.

Mr. Brad Hanson and Mr. Tim Wright of LaBelle Management spoke to the Board and were informed that it was the opinion of the Township Attorney that the Zoning Board of Appeals did not have the authority to grant variances for non-conforming signs within the Ann Arbor Road Corridor District.

Moved by Mr. Griffith, supported by Mr. Zdanek to rescind the previous affirmative vote on Application 1297 concerning the sign for Bennigan's Restaurant, 40441 Ann Arbor Road, and to deny said variance based on the opinion of the Township Attorney. 

Ayes all.


Moved by Mr. Bridgman, supported by Mr. Zdanek, to adjourn at 6:10 p.m.
