Meeting called to order at 5:00 p.m. by Chairman Levengood.

ITEM NO. 1 - APPROVAL OF MINUTES

1. Regular Meeting – February 5, 2004

Moved by Mr. Griffith, supported by Mr. Zdanek, to approve the minutes of the Regular Meeting of February 5, 2004, as presented.

The applicant is requesting one variance:

1. The applicant is proposing a six (6) foot high privacy fence in the rear yard. The required maximum height for a privacy fence is four (4) feet. With the proposed variance, the applicant is requesting a variance of two (2) feet in fence height.
Mr. and Mrs. Wayne Koppe addressed the Board and answered questions. Mr. Koppe presented a videotape of the traffic volume and noise near his home at the corner of Ann Arbor and Beck Roads.

The Board discussed various aspects of the request and the question raised by Mr. Jachym regarding the Board’s authority to grant fence height variances.

Moved by Mr. Sturdy, supported by Mr. Griffith, to table Application No. 1350, Wayne & Sharon Koppe, until the next meeting to seek guidance on how the issue can be properly handled.

The applicant is requesting one variance:

1. The existing primary residence has a thirty six point eight (36.8) foot side yard setback. With the proposed twelve (12) foot addition, the side yard setback would be twenty four point eight (24.8) feet. The applicant is requesting a variance of ten point two (10.2) feet onto the garage side of their house.

Arthur and Mable Partain addressed the Board and answered questions.

Mr. Levengood received permission from the Board to recuse himself from voting on this item because he is acquainted with the applicants.

Moved by Mr. Sturdy, supported by Mr. Griffith, to grant the 10.2 ft. side yard variance requested in Application No. 1352, D.J. Maltese for Arthur and Mable Partain, based on the information presented and the unique features of the curved lot line creating a personal hardship.

Ayes all, with Mr. Levengood abstaining.

Moved by Mr. Sturdy, supported by Mr. Zdanek, to adjourn the meeting.
